Hot Legal Issues and Enforcement Trends

The U.S. Department of Labor Wage and Hour Division, the U.S. Internal Revenue Service, in addition to the State Tax and Wage and Hour authorities have targeted the construction industry for Employee Misclassification Audits and Enforcement Actions. During this webinar, we will review the factors government agencies use in determining whether 1099 contractors are actually "employees" protected under state and federal minimum wage and overtime laws, as well as the unemployment insurance and worker's compensation laws. We will also discuss what remedial measures employers can take to correct misclassification decisions.
