California has enacted legislation to remove construction businesses’ ability to obtain indemnity for their own active fault from other parties connected with a project. This type of indemnity (called Type 1 – indemnity for own active fault) will be restricted effective January 1, 2013. You just signed a contract for a job starting January 2013. What’s in the fine print? And, it’s Monday afternoon. You get a call. Someone has fallen 20 feet from your scaffolding. It’s not your employee. It’s the plaster guy. The ambulance just left the job site. Five days later you receive a letter from the plaster guy’s attorney. So it begins.
